The message informing that the Supreme Court of Ukraine settled the cassation of LLC ‘Santos Capital’ in a dispute with JV ‘Western oil group’ and LLC ‘Zolotyi ekvator’ says that the defendants relate to WOG network of gas filling complexes. This information is far from reality because none of the mentioned above companies is a part of WOG Group.

In this regard, WOG does not bear any responsibility for the economic activities and debts of JV ‘Western oil group’.

As to LLC ‘Zolotyi ekvator’, a solidary defendant in the dispute, it should be noted that in 2018 the Supreme Court of Ukraine admitted the contract LLC ‘Santos Capital’ refers to prove other party’s debts as simulated, i. e. the agreement was closed with the purpose to release the other party from liability.

Therefore, the appeal of LLC ‘Santos Capital’ with a claim to JV ‘Western oil group’ and LLC ‘Zolotyi ekvator’ on debt collection is completely groundless.

It is worth mentioning that on June 18, the Supreme Court of Ukraine settled the cassation appeal of LLC ‘Santos Capital’, overturned the decision of the Northern Economic Court of Appeal dated April 2, 2019, and submitted the case No. 910/6706/17 to consider by the court of appeal.
